Can a car be in my name but insured by someone else?

Writer Nathan Sanders

You can insure a car that isn’t registered to your name if you’re the primary driver of the vehicle. You can’t get someone else to insure your car (like mum, dad, or your partner) if you’re the main driver.

Can you put a financed car in someone else name?

If you purchase a car for someone else, you have the option to have the loan in your name or to cosign with the individual you’re buying it for. The only way to buy the vehicle as a surprise is to put in the loan in your own name. The title may be registered under both names.

Can someone drive my car if they are not insured?

If a friend or a family member has an accident and isn’t insured, then you will have to use your insurance. Unless you have expressly denied that driver permission to use your vehicle.

What happens if someone crashes a car in your name?

If your friend is driving your car and gets in an accident, but the other driver was at fault, then the at-fault driver’s insurance will cover the damages and costs. Your insurance situation can get more serious if your friend was at fault for the wreck. However, your friend may not have any insurance at all.

Are you liable if someone else wrecks your car?

If you were not in your vehicle when it crashed, you may still be liable. In California, the vicarious liability doctrine allows for someone to be legally responsible for injuries even if they did not directly cause them.

Can I sell a car if the V5 is not in my name?

It’s actually entirely possible (and 100% legal) to sell a car and transfer ownership without a V5C document. Most people do not realise that the vehicle logbook is a record of the registered keeper, not proof of ownership.

Can you drive a car with someone else’s tax?

You can’t drive a car on someone else’s tax, either. The car policy gets cancelled once the ownership of the car is switched over. For example, if you buy a car in January that is taxed until March under the old owner’s name, you can’t use the tax. You’ll need to get your tax sorted as soon as it’s bought.

Can you go to jail for selling a car on finance?

The only reason you could go to prison for selling a car that is on a finance agreement, is if it can be proved that it was your intention to defraud the insurance company. This means that it would be dealt with in court should the finance company decide to sue you for the outstanding balance due on the car.

How does insurance work if someone borrows your car?

If a friend borrows your car and causes an accident, your insurance policy pays for any at-fault damages. A rule of thumb to remember in this situation is “car insurance follows the car, not the driver.” It’s still a good idea to make sure whoever drives your car has their own insurance policy, though.

Are you liable if someone has an accident in your car?

In general, the driver of the car is responsible for accidents, but the owner of a vehicle may also be held responsible if he or she knowingly allowed someone else to drive. However, if you do not have collision coverage, your insurance company will not pay for the damage to your vehicle.

Can you tax a car without it being in your name?

No, you can’t tax a car without a log book as you need the 11-digit reference number. If you’re a new keeper of the car and you don’t have a V5C in your name yet, then you can use your green new keeper slip and tax the car using the 12-digit reference number.
