In Texas, sales of photographs provided to customers as physical prints or as a digital or electronic image, are taxable. Tax is due on the labor charge associated with a photography or videography session as the selling, processing or remodeling of tangible personal property.

A charge for video photography for a client is subject to sales tax even if the client provides the videotape and camera. Motion pictures produced for private noncommercial use, such as weddings, etc., are excluded from “qualified motion pictures”. Sales tax applies to the charges for the videotapes.
